Surprise sanitation and stormwater utility customers will see changes on city utility statements beginning July 1, 2020, as rate increases determined by structured schedules are implemented.

Beginning July 1, 2020, single-family solid waste (trash) customers will pay a monthly base rate of $23.40. The rate schedule will then increase the rate by $0.10 each fiscal year beginning in 2021, bringing the rate to $23.70 on July 1, 2023. Residential water and wastewater utility rates will remain unchanged.

City of Surprise, Arizona Agrees to Repeal Nuisance Ordinance In March 2016, Nancy Markham, a domestic violence survivor, settled a federal lawsuit with the City of Surprise, Arizona. Ms. Markham had faced eviction under the City’s nuisance ordinance after calling the police multiple times for protection. Surprise’s ordinance prohibited landlords from continuing to rent to tenants who called the police four times within 30 days, or when two or more crimes occurred at the property at any time, with no exception for tenants who needed emergency assistance. The law also required landlords to adopt crime-free leases that authorized the eviction of tenants when any criminal activity occurred at the property. In August 2015, Ms. Markham sued the City, the city’s police chief, and a Surprise police officer for enforcing the municipality’s nuisance law against her, asserting First Amendment, due process, equal protection, Fair Housing Act, and other claims. The settlement includes the City’s repeal of the challenged ordinance provisions, an agreement not to enact another policy penalizing crime victims, monetary payment to Ms. Markham, and attorneys’ fees to be determined by the court. ▪

The Compliance Assistance Program (CAP) is a new program offered by the Surprise City Court to help individuals resolve past due financial obligations for civil traffic, civil and parking fines and fees. CAP allows individuals to enter into a time payment contract on most cases that may be preventing the reinstatement of driving privileges without seeing a judge.

I was recently reminded why we have a Council – Manager form of government, the reason being is that staff and the International City/County Management Association ( most management staff belong to the ICMA ) do not believe that our elected officials are qualified to manage a city.

There are so many cities including the city of surprise that the mayor or council have no control over the police department, not even approving the hiring of the police chief.

I believe that the employment of the police chief should be approved by the council and mayor. The mayor & council only hires and fires the city manager, city attorney and the city clerk.

If the mayor & council have no control over the police chief or the dept. how can they be responsible for their actions.
