Election violation

As the City Attorney is employed by the city council, help me to understand why this is not a conflict of interest.

A Surprise City Council member, who had yet to state his candidacy this year, violated election law after he mailed out holiday cards in December that asked recipients to vote for him this year.
District 1 Councilman John Longabaugh was fined $50 on Jan. 5, for distributing a holiday newsletter that ended with the message, “Vote for John on September 1, 2009.” Among the recipients was City Clerk Sherry Ann Aguilar, who, as the election supervisor, reported the violation to
City Attorney Michael Bailey.If city funds were used in the purchase and the mailing of these cards, it would be another violation.Leave a Reply
